Terms of Service

1. Acceptance of Terms

By accessing or using Strawberry (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

Strawberry is an AI-powered story writing tool that generates text content based on your prompts. The Service may allow NSFW/explicit adult content subject to these Terms and our Acceptable Use rules. We may add, modify, or remove features at any time.

Uptime/availability: The Service is provided "as is" and may be unavailable from time to time due to maintenance, provider outages, or other reasons.

3. Eligibility and Age Restriction (18+)

You must be at least 18 years old (or the age of majority where you live, whichever is higher) to use the Service. By using the Service, you represent you meet this requirement. We may require additional age-verification steps where legally required.

4. Accounts and Security

• You may need an account to use certain features.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• One user per account. You may not share accounts, resell access, or allow others to use your subscription.
• You may not use bots, scrapers, or automated tools to access or generate content unless we explicitly allow it in writing.

5. Acceptable Use Policy (AUP)

You agree not to use the Service to create, request, upload, generate, share, or distribute any content that:

• Involves minors in any sexual context, or any content that sexualizes minors (zero tolerance).
• Depicts or promotes non-consensual sexual content, sexual violence, or exploitation.
• Facilitates or promotes illegal activity, including trafficking, solicitation of illegal services, or instructions to commit wrongdoing.
• Contains hateful or harassing content targeting protected groups, or incites violence.
• Includes real-person sexual content without consent, or doxxing/private personal information.
• Attempts to bypass safety systems, or asks for disallowed sexual content involving minors.
• Interferes with or disrupts the Service, attempts to gain unauthorized access, or reverse engineers provider safeguards.

Enforcement: We may remove content (including titles), restrict access, suspend, or terminate accounts at our discretion, including for suspected violations. We may report illegal activity to appropriate authorities where required.

6. Intellectual Property and Third-Party Rights

You may not use the Service in a way that infringes, misappropriates, or violates any copyright, trademark, trade dress, or other rights of any person or entity. You are responsible for ensuring your prompts, generated content, and any content you publish or distribute using the Service do not violate third-party rights. We do not grant you any rights to use third-party IP. Use of third-party characters, brands, or other protected material may require permission from the rights holder. We may remove content and/or terminate accounts in response to infringement notices or complaints.

7. Your Content; Ownership; License

Your ownership: As between you and Strawberry, you retain whatever rights you have in your prompts and generated outputs.

Limited license to operate the Service: You grant Strawberry a limited, non-exclusive license to host, store, and display your story titles and necessary account metadata solely to provide and improve operation of the Service (e.g., showing your library list, syncing devices).

No access to story text: We do not store or access your story text/outputs on our servers, except transiently as needed to transmit your prompt to AI providers and return the generated result to you.

8. AI Providers and Generated Content Disclaimers

The Service uses third-party AI model providers, which may include OpenAI, xAI, and DeepInfra (Orpheus) (collectively, "AI Providers"). To generate content, your prompts and related request data must be transmitted to the relevant AI Provider.

Generated content may be inaccurate, offensive, or unwanted. Outputs are generated automatically and may not reflect our views. You are responsible for how you use and share outputs.

No professional advice: The Service is for creative writing and entertainment; it does not provide legal, medical, financial, or other professional advice.

9. Plans, Subscriptions, Billing

Payments (Stripe). Paid plans are processed through Stripe (our third-party payment processor). By purchasing a subscription, you agree that Stripe may collect and process your payment information on our behalf. We do not store your full payment card number. Your subscription will auto-renew unless you cancel before the renewal date. Taxes may apply depending on your location.

Refunds. All fees are non-refundable except where required by law.

• Price changes: We may change prices with prior notice; changes apply at the next renewal unless stated otherwise.
• Chargebacks: We may suspend accounts for chargebacks or suspected fraudulent activity.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if we believe you violated these Terms or if required by law or an AI Provider. Upon termination:

• Your account access ends.
• We may retain certain records as required for legal, tax, or security reasons.
• Titles and account data may be deleted per our Privacy Policy, subject to retention requirements.

11. Warranty Disclaimer

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate or acceptable.

12. Limitation of Liability

To the maximum extent permitted by law:

• Strawberry will not be liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) $100 or (b) the amount you paid to Strawberry in the 3 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted.

13. Indemnification

You agree to defend, indemnify, and hold harmless Strawberry and its affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your prompts, outputs, your use of the Service, or any allegation that your content infringes or violates a third party's rights or law.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, excluding conflict of law rules. Any dispute will be brought exclusively in the courts located in Suffolk County, Massachusetts, and you consent to jurisdiction and venue there.

15. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., by posting on the site or emailing you). Continued use after changes means you accept the updated Terms.
